Refusing to perform a same-sex union is a violation of civil rights in the same way refusing to perform an interracial marriage would be. Sexual orientation is a protected class like race.

On another topic, you should be glad to know that a former board member of the ACLU is siding with Christian conservatives on an issue. In Massachusetts there is a proposal to widen the no-protest border around abortion clinics from 18 to 35 feet. The ACLU former board member spoke out against it, saying it was a free speech violation. If this proposal became law, the ACLU might very well take up the case.
