By the definition of an Anti-hero found on villians.wikia and by Stan Lee. As well as generally accepted comic book enthusists. What you are describing is an anti hero. A hero who follows his own rules or breaks the rules for the greater good. Batman and Superman are heroes cause they aren't willing to kill, but Red Hood and the Punisher will kill in order for the greater good and safety of others.
