How about using the "Ace up your sleeve". Your bad guy meant someone that he things he can trust, and is tricked into coming back into the USA. He might not even know he was heading there till its to late. Or the bad guy sneeks back into USA for imporatnt reasons, (maybe that is the trick) and he is cought.

Besides guns are to easy. Make it a challange to get him back into the USA.
