Preamble:

We the United the People of Daxam assembled, valuing peace, life, liberty, justice, and equality, recognizing the necessity of law, do hereby declare this Constitution the supreme law of the People’s Republic of Daxam, reflecting the wills, voices, and determinations of the People of Daxam together.

Section I: Executive Branch




I.The President of Daxam is the Head of Government, and of State.

II.The President has the privilege of “shuffling” (re-arrange) their cabinet at their wish and/or firing members of the cabinet with consent of the Senate. The Congress as a whole must approve of the President’s appointed Cabinet.

III.As Commander-in-Chief of the United Forces of the Army, The President may take be the forerunner of military operations along with the Secretary of Defense. The President has the right to keep documents classified about military operations throughout their term in which all documents shall be released for the public unless military conflict has not been resolved post term. The President does not have to answer to anyone concerning secret military actions, with the exception of the Secretary of Defense.

IV.The maximum number of terms one President can hold office is two, until a term has passed. Each term is expected to be 2 months; the same time line of a session of Congress.

V.The Impeachment of the President is the responsibility of Congress Impeachment may be found under the following grounds of treason, lying under oath, responsible or involved in military/political conspiracy/coup, foul language, poor service to the people, undeclared inactivity for 14 days or more, bribery, and abuse of political power. It takes ¾ of Congress to impeach the President.

VI.The President has the power to create executive orders to quicken things up, without parliamentary approval. The President has the very power to pardon any convicted or charged person(s) of crimes.

VII. The Cabinet of the President shall be: Secretary of Foreign Affairs, Defense, Media, Culture, Recruitment, WA Delegate and History. The President’s two Advisers, will also be in President’s cabinet.

VIII.The Presidential Line of succession, is if the President died, resigned, or is impeached, is the following: Speaker of the House, Senate Majority Leader, Secretary of Defense, Foreign Affairs, and WA Delegate.

XI. The World Assembly Delegate (WAD) is the Delegate for our great Region, the elections for this, shall be every month. A Delegate can serve an unlimited terms in office. The Delegate will post the current Resolution with the WA in the Department of the WA and will set a poll, the poll with a Majority, will be the vote that the Delegate will use.

Section II-Legislative Branch

I. The House of Representatives will have 3(this number can/will be changed as we grow) seats, each elected by the citizens of Daxam

II. It is the responsibility of the House of Representatives to debate and vote on proposals submitted by any citizen of Daxam.

III. The House of Representatives passes a bill by a simple majority vote, subject to appropriate and reasonable legislation.
If approved the bill is sent to the President for approval or veto.

IV. The House of Representatives has the power to grant pardons for crimes with a unanimous motion

V. All members of the House of Representatives may vote, debate, and propose legislation

VI. The House of Representatives has the power to overturn the President's Veto with a 2/3 majority vote, subject to appropriate and reasonable legislation

VII. A Speaker will be elected among the Representatives, a simple majority will make the Speaker. The Speaker will lead the bill to discussion, shall be responsible for the various tasks assigned to them by the House of Representatives, and the people. The Speaker shall have the authority to bring legislation to vote, pass legislation to the President, call for special assemblies, and organize committees.

VIII. The Speaker shall have the authority to assign takes to other Representatives, and shall advise the President on executive decisions.

IX. A Representative can serve an unlimited amount of terms. One full term, is one month.

Section III: Judicial Branch

Article I: The Judicial Branch

I. The Judicial Branch shall consist of a Chief Justice (presiding over the Supreme Court) and a Lower Court Judge (presiding over the Civil Court).


Article II: The Chief Justice

I. The Chief Justice serves for life or until resignation or removal from office.
i. The Chief Justice is appointed by the President and confirmed by a 2/3 majority vote of the House of Representatives
ii. The Chief Justice may be removed for a gross abuse of power by a 2/3 majority of the House of Representatives and with the agreement of the President.


Article III: The Lower Court Judge(s)

I. The Lower Court Judge serves for life or until resignation or removal from office.
i. The Lower Court Judge are appointed by the President and confirmed by a majority vote in the House of Representatives.
ii. The Lower Court Judge may be removed and replaced by the President.


Article IV: The Civil Courts

I. The Civil Courts shall be the entry level for all case
II. The Civil Courts shall have the power to rule in criminal and civil cases, and to offer legal remedies as may be proscribed by law.
III. The Civil Courts shall have appellate authority over regional courts, should any exist.


Article V: The Supreme Court

I. The Supreme Court shall be the last court of appeal in Daxam, and have appellate power over all other courts
II. The Supreme Court shall hear all inter-governmental cases.
III. The Supreme Court may hear non-binding reference questions.
IV. The Supreme Court may deny any appeal for any reason.

Section IV– Rights and Liberties

I. Residents

1. A resident shall be defined as a member of Daxam who has not been granted citizenship.


II. Residents’ Rights

i. All residents of the People's of Daxam shall be granted the freedoms of thought, speech, religion, expression, and belief.
ii. All residents shall have the right to apply for citizenship.
iii. All residents shall have to right to peaceful assembly with whomever they wish.

III. Citizens

i. A citizen shall be defined as a member of Daxam who has been granted citizenship.


IV. Citizens’ Rights

i. All citizens of the People's Republic of Daxam shall be granted the freedoms of thought, speech, religion, expression, belief, press, petition, and peaceful assembly.

i. Any citizen of the People's Republic of Daxam shall have the right to join or create political parties.

iii. All nations of the People's Republic of Daxam shall have the right to bear arms and form a military for the public defense.

IV. All citizens of the People's Republic of Daxam shall have the right to own property, and all nations within the Kingdom of Daxam shall the right to establish territories and colonies, without the forceful seizure of their property from the government.

V. All citizens shall have the right to adopt, be adopted and to deny a request for the same.

VI. All citizens of the People's Republic of Daxam shall not be subject to harassment or excessive fines.

VII. All citizens shall have the right to a fair trial.

VIII. All citizens of the People's Republic of Daxam shall not be subject to torture.

IX. No citizen of the People's Republic of Daxam shall be forced to quarter military or government officials, neither shall any nation be forced to quarter foreign military or government officials.

X. All rights guaranteed to the citizens of the People's Republic of Daxam under this Constitution shall not be nullified by any act of Congress, executive order, or dissolution of government.

Section V-Elections


I. In order to be eligible to run for public office one must be a citizen of Daxam or one of her territories.

II. Elections for the House of Representatives shall be held on the last Thursday of every month; the end of the Representatives term in office.

III. Campaigning will start one week before elections, for both President, and House.

IV. The incumbent Attorney General, is responsible for setting calling Elections, Nominations, and other elections.

V. If a tie occurs within the House, the Attorney General may vote once more to break the tie. If a tie happens within the Presidential race, a reelection must be held, if there is still a tie, one more, and final reelection must be held, if the tie is still, the Attorney General, must break the tie.

VI. The Presidential election will be exercised every two months; the end of the President’s term in office.
--i. The Presidential Election shall on Friday of the second month.

VII. If two or more persons in a Party decides to run for President, those persons must seek a nomination, if there is a tie in the nominations, both persons may both run for President, there is no tie breaker.

VIII. The winner of the election for the office of President, or any other high office, shall be inaugurated and sworn in to office by the Chief Justice.

IX. Elections for the World Assembly Delegate, shall be every month, and the uncumbent Delegate may serve an unlimited amount of terms. Elections will be held on the first Tuesday. All WA Members, are automatically candidates for Delegate unless they refuse to run.

Section VI: Amendments


I. All amendments to the Daxam Constitution must be proposed in the Legislative Branch.

II. An amendment must recieve 2/3 of the vote to be considered passed. If it does not pass, it is scrapped, and must be re-introduced if it should be considered again.

III. If an amendment is passed by the Legislative, it must be presented to the people of Daxam for ratification via a poll topic. This is the responsibility of the Speaker. The amendment must receive a 2/3 majority here, as well. If it does not pass, it is scrapped, and must be re-introduced if it should be considered again.

IV. If the amendment passes in the manner described in Article III, it is sent to the President for approval.

V. The President may sign or veto the amendment. If vetoed, the amendment is scrapped and must be re-introduced if it should be considered again, or the House of Representatives may overrule the veto with a super majority of 2/3 (to be changed to 4/5 or so after the HoR grows). If signed, the amendment becomes a part of the Daxam Constitution.
